A JCT Clause 21.2.1 insurance policy will provide cover against liability for damage to adjacent or surrounding property even if the work is being carried out by a contractor or sub-contractor.

Often damage occurs where there's work involving demolition, excavation, piling or underpinning where damage is caused by subsidence, vibration or weakening of foundations. Taking into consideration such things as the geology and landscape and the proximity of other properties to your site affect the level of risk you face. The joint contracts tribunal 21.2.1 insurance cover protects you for damage that has not been caused by the negligence of the party carrying out the work.

Why do I need JCT Clause 21.2.1 Insurance?

A public liability insurance policy will only protect you against damage to third party property if the damage has resulted from negligence. If for any reason your work damages a property nearby, you could be liable for the resulting damages, this would add a financial burden and even cause your project to be seriously delayed.

JCT Clause 21.2.1 insurance comes from the relevant section of the Joint Contracts Tribunal (JCT) standard form of building contracts, which is a relatively complex area. The requirement for cover is generally stipulated by a consulting engineer, surveyor or architect, so it’s best to seek the advice of an expert. The policy is issued in the name of the contractor as well as yourself to ensure all parties are protected.

Self Build JCT 21.2.1 Insurance covers you for any expense, liability, loss, claims or proceedings as a result of damage to surrounding property which is a result of:
  • Collapse
  • Subsidence or heave
  • Vibration
  • Weakening or removal of support
  • Lowering of ground water
